LA INCLUSIÓN DEL ABUSO DE INFORMACIÓN PRIVILEGIADA COMO TIPO PENAL DENTRO DEL COIP

Abstract

The present work focused on an analysis of the criminal figure of abuse of privileged information and on its treatment in Ecuador. The analysis was initiated, through the study of a legal inventory, where the criminally relevant scenarios regarding the privileged information were detailed. Subsequently, the general characteristics of the crime were analyzed, which were helpful in finding the crime that subsumes the conduct. Therefore, it was concluded that although the behavior of spreading privileged information can be subsumed within an existing criminal type, there is a problem and a legal void regarding the treatment provided for the use of privileged information.
