EXPERIMENTACIÓN ANIMAL EN LA INDUSTRIA COSMÉTICA: REGULACIÓN EN EL ORDENAMIENTO JURÍDICO ECUATORIANO

Abstract

Animal experimentation in the cosmetic industry is a global environmental problem, it has tried to be fought by the different international organizations in defense of animal rights. Previously in Ecuador, animals were considered as objects and there were no regulations on experimentation with animals for cosmetic purposes. However, at the present, the Environmental Organic Code rejects this and recognizes them as sentient beings; and provides legal protection to animals, prohibiting experimentation for the cosmetic industry. However, the problem lies in the fact that the regulation within the Ecuadorian legal system is not exhaustive compared to other Latin American countries, leaving many empty questions and being able to unprotect the rights of animals, which precisely are intended to protect with the prohibition; therefore, the result of this would be a lack of coherence within the legal system. Within this work the analytical-descriptive methodology has been used, allowing to conclude that for the protection of animals against experimentation an exhaustive regulation is necessary that prohibits the practice as such, the production and import of the products contained within its ingredients, combinations or formulas tested on animals.
